The Free Trade Deception- How They Are Being Used to Undermine Our Constitution- Part One

By Terry | American Decline

[dropcap color=”color-default” font=”geneva” style=”oblique” size=”scmgc-3em”]Q[/dropcap]uite frankly the complacency with which Americans seem to accept everything they are told by people who have obviously already deceived them repeatedly (politicians and our government) is sometimes mind boggling to me. You would think by now, as lie after lie has been fed to us and uncovered, the knee jerk reaction would be to question everything the mainstream media and politicians say or print. That doesn’t seem to be the case with these so-called “free trade” agreements.

Most people it would appear simply accept these agreements at face value. They consider them beneficial to our nation. After all what can be wrong with “free” trade. In truth and fact, free trade is neither beneficial nor free!

The First Deception

Free trade is good for our nation- Isn’t that what we are sold by the media and our politicians and President? In fact, Obama was being pilloried by the media for not getting free trade agreements passed. How utterly naive to buy that line of absurdity.

The actual fact is, these free trade agreements are undermining our Constitutionally established national sovereignty which is to say our capacity to govern our own nation.

How Free Trade Undermines our Constitution and National Sovereignty

All of these agreements from NAFTA to the most recent agreements cede the control of foreign trade from our elected representatives in Congress to the United Nations. What people have not been told and what the agreements actually are and do are two completely different things.

The capacity to regulate trade for the States was one of the primary concerns which promoted a change in the Articles of Confederation. The colonies wanted to negotiate as a trading block because it gave them more leverage with trading partners. It offered more protection against pirates and cargo hijacks from other nations. It gave our nation more control over the trading process itself.

The adopted Constitution reflected those concerns in Article I, Section 8 as follows:

The Congress shall have the power….

To regulate Commerce with foreign nations, and among the several States, and with the Indian tribes;

To define and punish Piracies and Felonies committed on the high Seas, and offenses against the Law of Nations;

To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;

However, the so-called Free Trade agreements are quite simply an UnConstitutional surrender of our sovereign trade authority to an international body. By approving them, Congress is ceding its authority to the United Nations. This is in direct opposition to the intent of our rule of law or the United States Constitution.

What it does do however is to place yet another brick in the new world order architecture of which the UN serves as a template that George Bush and others have referred to over the years:

“When we are successful, and we will be…….” Pretty confident about that wasn’t he? Don’t know about you but it ruffles my feathers and sticks in my craw as they say.

These are some of the actual provisions of the 2012 Columbia free trade agreement:

Chapter One
Initial Provisions and General Definitions

Section A: Initial Provisions

Article 1.1: Establishment of a Free Trade Area

The Parties to this Agreement, consistent with Article XXIV of the GATT 1994 and Article V of the GATS, hereby establish a free trade area.

Article 1.2: Relation to Other Agreements

The Parties affirm their existing rights and obligations with respect to each other under the WTO Agreement and other agreements to which such Parties are party.

[End of excerpt]

Do you see under whose authority the agreement is provisioned? Pretty obvious isn’t it when you actually read the words of the agreement. The WTO BTW is a Related Organization in the UN System.

Free? How if….

the UN is the controller under these agreements NOT the U.S. or our Constitution? You know that thingy that each elected representative from the President on down takes an oath to protect, defend and uphold.

Under the trade agreements the Constitution is simply out the window. Traded away by our wonderful representatives while the media chirps on about how beneficial they are to U.S. trade just like Obama, Clinton, and Bush did when they were pushing to have them approved by the Senate as treaties. Anything beginning to smell a bit fishy here? I certainly hope so.

In the next part, we’ll look at how free these free trade agreements actually are.
